The 5th Gear Riders – Terms & Conditions

Disclaimer & General Understanding

  • The 5th Gear Riders is an informal, non-commercial, and unregistered community of motorcycle and automobile enthusiasts.
  • The club’s purpose is purely recreational — to organize and coordinate community rides, drives, and related social events.
  • Participation in any activity organized by The 5th Gear Riders is entirely voluntary and at the participant’s own risk.
  • The club, its coordinators, and volunteers are not responsible for any accidents, injuries, damages, or losses that may occur before, during, or after an event.

Participation & Registration

  • Every Rider/Driver/Pillion/Passenger must register through the official website, social media channel, or form before taking part in any ride or event.
  • Participants must be medically and physically fit to undertake the ride. Responsibility for fitness lies entirely with the individual.
  • Each participant must carry their own food, water, and first-aid kit. The use of helmets, gloves, jackets, knee guards, and safety gear is strongly recommended.
  • Members are expected to maintain discipline, peace, and mutual respect within the group and avoid any conduct that could endanger others or harm the club’s reputation.
  • Every Rider/Driver must carry all valid vehicle documents, including:
  • Driving License
  • Vehicle Registration Certificate
  • Valid Insurance
  • Pollution Under Control (PUC) Certificate
  • All participants must comply with the Motor Vehicles Act, 1988 and relevant traffic laws of India.
  • The club will not be responsible for any fines, penalties, or legal issues arising from a participant’s non-compliance with traffic regulations.
  • The club does not provide any insurance coverage (personal or vehicle). Participants are advised to maintain their own valid insurance policies.

Liability & Indemnity

  • Riding/driving involves inherent risks, including the possibility of serious injury, accident, or property damage.
  • By participating, you acknowledge and accept these risks voluntarily.
  • The 5th Gear Riders, its members, coordinators, and volunteers shall not be held liable for any injury, loss, damage, accident, or death arising directly or indirectly from participation in any event.
  • Participants agree to indemnify and hold harmless The 5th Gear Riders, its organizers, and volunteers against any claim, demand, or loss resulting from participation in any activity.

Code of Conduct

  • Consumption of alcohol, drugs, or intoxicating substances before or during any ride/event is strictly prohibited. Violation will result in immediate disqualification and removal from the club.
  • Participants must respect fellow riders, the environment, and local communities. Littering, rash driving, or disrespectful behavior is not tolerated.
  • The organizing team reserves the right to deny participation to any individual deemed unfit, unsafe, or non-compliant with club guidelines.
  • By joining any event organized by The 5th Gear Riders, participants consent to being photographed or recorded during the activity.
  • The club reserves the right to use such photographs or videos for social media, promotional, or community purposes without requiring additional consent or offering compensation.

Additional Provisions

  • In the event of a vehicle breakdown or emergency, the club may offer reasonable assistance but will not bear any repair, towing, or transport costs.
  • Any registration fee or contribution (if collected) is non-refundable, except if the event is cancelled by the club.
  • As The 5th Gear Riders is an unregistered group, no legal contract, partnership, or employment relationship exists between participants and organizers.
  • Any disputes or grievances will be resolved amicably within the group, without legal recourse or jurisdictional claims.

Sponsorships & Collaborations

  • The 5th Gear Riders may collaborate with brands or sponsors for events, promotions, or product trials. All collaborations are reviewed and approved by the organizing team to ensure alignment with the club’s values.
  • The club does not endorse or guarantee the quality, safety, or performance of any sponsored product or service.
  • Participation in sponsored activities or product use is entirely at the participant’s own risk.
  • Any financial or in-kind support from sponsors will be used solely for managing community expenses, activities or event expenses.
  • Such contributions do not create any ownership, partnership, or profit-sharing rights with The 5th Gear Riders.
  • The club reserves the right to decline or end any sponsorship that is misleading, unsafe, or against community interests.
  • Any use of The 5th Gear Riders’ name, logo, or branding requires prior written consent from the Founder.

By registering for or participating in any event organized by The 5th Gear Riders, I hereby confirm that:

  • I have read, understood, and agreed to all the above Terms & Conditions.
  • My participation is entirely voluntary and at my own risk.
  • I release, discharge, and indemnify The 5th Gear Riders, its coordinators, and members from any liability, claim, or loss arising from my participation.
